Property Division FAQ's

WHAT CAN OUR FIRM DO FOR YOU?

How do you take what you have accumulated over your life and divide it?

You, with your attorney, will set out initial needs and goals. You will then work to meet those goals. Your attorney will advise you whether those goals are realistic given the facts of your case and the present state of the law.

WHAT FACTORS GO INTO ASSET/LIABILITY DIVISION?

Numerous factors go into asset division: What are the assets? What are the debts? Who has the ability to pay? Who has the ability to earn income in the future? What are the impediments to earning income? What has the lifestyle been? Are there children? How much is needed to support them? These and many other factors will be taken into consideration under the law to calculate an equitable settlement.

WHAT QUESTIONS CAN I EXPECT TO HAVE ANSWERED?

Can I keep one asset and trade something or several things for it? What are the up and down sides of doing it that way? Will I have to pay all the debt? Does it matter whose name is on it? Am I entitled to keep everything I earned? Can I get my spouse to pay my attorney fees? Do I have to share assets I had before marriage? How does payment of child support and/or maintenance bear on the asset split? What are the tax consequences? Will I pay capital gains if I get stock or retirement? How do I get access to information about my children? What is a parenting plan?
